This privacy statement applies to Circular Plastics B.V., with registered offices in Aalsmeer, and all its associated companies, to be referred to hereinafter as Circular Plastics.

Personal data

An item of personal data is any item of data that relates to an identified or identifiable natural person. That means that information is directly about someone or can be traced back to that person. The fact that it must be about a natural person means that data relating to persons who are deceased or to organisations is not personal data.

Circular Plastics processes the following personal data which is only used for the purposes described under the subheading “Purposes and legal bases”:

  • Name
  • Gender
  • Telephone number
  • E-mail address
  • Position
  • IP address

Purposes and legal bases

The data that we process is used for the following purposes:

  • To conduct the normal course of trade between Circular Plastics and its trade partners
  • To combat fraudulent acts during the course of trade
  • To handle webshop orders
  • To provide customer support in real time on the websites of Circular Plastics
  • To analyse the shopping behaviour of customers on websites of Circular Plastics (using at least – but not exclusively – Google Analytics)
  • To send out (digital) newsletters
  • To fulfil tax obligations

Newsletters

If you register for our newsletter, we use the data required for this or provided separately by you to send you our e-mail newsletter regularly based on your consent in accordance with art. 6 para. 1(1a) of the GDPR. You can unsubscribe from the newsletter at any time by sending a message to the contact person specified below or via a link provided for this purpose in the newsletter. After unsubscription, we will delete your e-mail address, unless you have given us your express consent regarding further use of your data or we reserve the right to continue to use data which is permitted by law and about which we have notified you in this statement.

Consequences of not providing personal data

If the personal data mentioned is not provided, it is not possible for trade to be conducted with Circular Plastics, or only with restrictions.

If such a situation arises, Circular Plastics will inform the person concerned of the restrictions resulting from the non-disclosure of some or all of the personal data.

Recipients

(Some of) the personal data requested and received will be passed on to the following parties:

  • Hostnet with registered offices in Amsterdam for website hosting/management
  • Exite ICT with registered offices in Enschede for the management of e-mails
  • Sylt Support with registered offices in Aalsmeer for the management of the websites of Circular Plastics
  • Mailchimp with registered offices in Atlanta, GA, United States for the facilitation of the digital newsletters.
  • Banking relationship Rabobank Waterland

Circular Plastics has entered into agreements with the above-mentioned recipient(s) to ensure compliance with the GDPR.

Cookies

The websites of Circular Plastics use cookies. A cookie is a simple text file that is downloaded with pages from this website and stored on your computer by your browser.

Users can refuse to accept those cookies, although doing so can severely limit the functionality and use of the websites or make it impossible to use them at all.

Google Analytics and similar services

Circular Plastics currently uses Google Analytics on its websites to track how visitors use the website. This information is stored by Google on servers in the United States along with the IP address of the computer. Google uses this information to track how the websites are used so that it can send reports on the websites to Circular Plastics and be able to provide its advertisers with information on the effectiveness of their campaigns.

Google may provide that information to third parties if Google is obliged to do so by law or insofar as those third parties process the information on behalf of Google. Circular Plastics has no influence on this.

Social Media

The websites of Circular Plastics contain buttons (and/or links) enabling the promotion or sharing of pages via various social media channels. Those buttons are created using code supplied by the relevant companies. That code places a cookie to enable visitor behaviour to be analysed, for example.

Read the privacy statement of these social media (which can change regularly) to find out what they do with the personal data that they process with that code. Circular Plastics has no influence on this.

Hotjar

Circular Plastics uses Hotjar to analyse visit behaviour. Hotjar is used to record mouse clicks, mouse movements and scrolling activities, for example. That information is processed and stored anonymously. In addition, Hotjar suppresses all personally identifiable information when viewing visit behaviour.

Duration of storage

Circular Plastics will store personal data:

  • For as long as it is reasonably necessary to do so in order to facilitate the normal course of trade
  • For as long as it is reasonably necessary to do so in order to safeguard the interests of Circular Plastics in respect of combatting fraud
  • As long as there is a legal or tax obligation to do so
  • As long as no request for the deletion of personal data has been received from the data subject

Security

We take the protection of your data seriously and take appropriate measures in order to prevent misuse, loss, unauthorised access and unauthorised changes. In any case, those measures include:

  • The adequate protection of our servers and network(s)
  • The adequate protection of our software packages by means of login and password protection
  • The use of a rights structure in the software packages so that the number of employees who have access is restricted to the employees who need to have access in order to be able to do their job properly
  • The use of function separation within the administrative organisation

Right of inspection, rectification and/or deletion

As a data subject, you have the following rights: In accordance with art. 15 of the GDPR, you have the right to request information regarding the personal data that we process about you insofar as that information is described therein; in accordance with art. 16 of the GDPR, you have the right to demand the immediate correction of any incorrect or incomplete personal data stored by us; in accordance with art. 17 of the GDPR, you have the right to request the deletion of any personal data stored by us relating to you, unless further processing is required

  • To exercise the right to freedom of expression and of information;
  • To comply with a statutory obligation;
  • For reasons of general interest, or
  • To enforce, exercise or defend legal claims; in accordance with art. 18 of the GDPR, the right to request the restriction of the processing of your personal data, insofar as
  • You dispute the correctness of the data;
  • The processing is unlawful but you refuse to delete the data;
  • We no longer require the data but you do require them in order to enforce, exercise or defend legal claims, or
  • An objection to processing was made in accordance with art. 21 of the GDPR; in accordance with art. 20 of the GDPR, you have the right to receive the personal data that you provided us with in a structured, current and machine-readable format or to request the transfer thereof to another responsible person; The right to submit a complaint to a supervisory authority in accordance with art. 77 of the GDPR. As a rule, you can contact the supervisory body from your usual place of residence or workplace or from our head office.

Circular Plastics wishes to expressly point out in this connection that after withdrawing consent, it will not be possible for trade to be conducted with Circular Plastics or only with restrictions.

Circular Plastics also wishes to expressly point out that it will not comply with any such request if a statutory – or tax – obligation potentially opposes it or if an ongoing fraud investigation is jeopardised. If Circular Plastics does not comply with the request from the data subject, then it shall notify the data subject accordingly, giving (a) reason(s).

For requests regarding inspection or deletion of your data, please contact us using the above contact details. Circular Plastics will respond to your request as quickly as possible, but at the latest within four weeks.

Complaints

The data subject has the right to submit a complaint regarding the processing or handling of personal data. A complaint can be submitted to the Personal Data Authority. It is only possible to do so if the data subject has already submitted a substantiated complaint to Circular Plastics.
